1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of ISBIS, a marketplace that connects applicants and their families with independent schools, short-term study programmes, and certified education agents. By creating an account or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. Definitions

"Applicant" means a prospective student, or a parent/guardian acting on a prospective student's behalf, using the Platform to research and apply to Schools. "School" means an independent school, college, or short-term study programme provider listed on the Platform. "Agent" means a certified education agent or agency who assists Applicants with the admissions process. "Account" means the registered profile through which a user accesses the Platform. "Content" means any information, documents, or materials submitted to the Platform by any user.

3. Eligibility and Account Registration

You must provide accurate, current, and complete information when creating an Account and must keep that information up to date. Where an Account is created on behalf of a minor applicant, the individual registering confirms they are a parent, legal guardian, or otherwise authorised to act on the applicant's behalf. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account.

4. Applicant Responsibilities

Applicants agree to submit truthful and accurate personal, academic, and preference information, including details used for school matching, competitive assessments, and applications. Providing false or misleading information may result in the rejection of an application, suspension of your Account, or removal from the Platform.

5. Role of Schools and Agents

ISBIS acts as a facilitator that connects Applicants with Schools and Agents; it is not a school, admissions office, or agency itself and does not make admissions decisions on behalf of any School. Interactions, agreements, fees, and communications between an Applicant and a School or Agent are the responsibility of those parties. ISBIS does not guarantee the accuracy of listings provided by Schools or Agents, though it takes reasonable steps to verify certified Agents and listed Schools.

6. Application Process and Communications

Submitting an application, favouriting a School, or requesting a match through the Platform does not constitute an offer of admission or any guarantee of acceptance. Admission decisions rest solely with the relevant School. By using the Platform, you consent to receive service-related communications (such as verification codes, application status updates, and account notices) by email or other contact details you provide.

7. Fees and Payments

Where a School or Agent charges application, tuition, or service fees, those fees are disclosed by the relevant School or Agent and are payable directly to them under their own terms, unless otherwise stated on the Platform. ISBIS is not responsible for refunds, disputes, or payment issues arising from arrangements between Applicants and Schools or Agents.

8. Data Protection and Privacy

Personal data submitted to the Platform, including academic records, personal statements, and contact details, is processed in order to operate the Platform, facilitate school matching, and share relevant information with the Schools and Agents you choose to engage with. We take reasonable technical and organisational measures to protect your data, and we do not sell personal data to third parties. You may request access to, correction of, or deletion of your personal data by contacting us through your account settings.

9. Intellectual Property

The Platform, including its design, branding, and underlying software, is the property of ISBIS and its licensors and is protected by applicable intellectual property laws. You retain ownership of Content you submit, but grant ISBIS a licence to use, store, and share that Content with relevant Schools and Agents solely for the purpose of operating the Platform.

10. Prohibited Conduct

You must not misuse the Platform, including by submitting fraudulent applications, impersonating another person, attempting to bypass verification processes, scraping or harvesting data, or interfering with the Platform's normal operation. ISBIS may investigate suspected misuse and take appropriate action, including Account suspension.

11. Disclaimers

The Platform is provided on an "as is" and "as available" basis. While we strive for accuracy, ISBIS does not warrant that school listings, matching results, or competitive assessment outcomes are complete, error-free, or a guarantee of future admissions success.

12. Limitation of Liability

To the fullest extent permitted by law, ISBIS shall not be liable for any indirect, incidental, or consequential loss arising from your use of the Platform, or from the acts or omissions of any School or Agent, including admissions decisions, fee disputes, or the quality of education provided.

13. Termination and Suspension

You may stop using the Platform and close your Account at any time. ISBIS may suspend or terminate an Account that breaches these Terms, provides false information, or engages in conduct that harms the Platform, its users, or partner Schools and Agents.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in the Platform or applicable law. Material changes will be reflected by updating the "Last updated" date below. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws applicable in the jurisdiction in which ISBIS operates, without regard to conflict of law principles, and any disputes will be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
